Terms of service
These Terms of Service govern your use of amberwall.co and any purchase you make from it. By using this website or placing an order, you agree to them. Please read them alongside our Privacy Policy, Shipping Policy and Refund Policy, which form part of these terms.
The store
This website is operated by Amberwall, an independent clothing label based in New Jersey, United States. “We”, “us” and “our” refer to Amberwall; “you” refers to any visitor to the site or purchaser of our garments.
Eligibility
You must be at least the age of majority where you live to place an order, or have the consent of a parent or guardian. By ordering you confirm that the payment method used belongs to you, or that you are authorised to use it.
Products and availability
Garments are produced in limited quantities and are sold while stock lasts. We may change, limit or discontinue any product at any time. Colour and texture can appear differently from screen to screen, and small variations between individual garments are a characteristic of how they are made rather than a fault.
Pricing and errors
Prices are shown in US dollars and may change without notice. We try to describe and price everything accurately, but if a product is listed at an incorrect price or with a material error in its description, we may cancel the order and refund you in full, even if the order has already been confirmed.
Orders
Your order is an offer to buy, which we may accept or decline. We may refuse or cancel any order, including where we suspect fraud, where an order appears to be placed for resale, or where stock turns out to be unavailable. If we cancel an order you have already paid for, we refund it in full.
Payment
Payment is taken at checkout and handled by our payment provider. We do not store your card details. Any bank charges or currency conversion fees applied by your card issuer are your responsibility.
Shipping and risk
Delivery estimates are estimates, not guarantees. Risk of loss passes to you once the carrier delivers the parcel. Import duties and taxes on international orders are the responsibility of the recipient. Our Shipping Policy sets out the detail.
Returns
All sales are final. We do not accept returns, exchanges or cancellations, other than for garments that arrive damaged, faulty or incorrect. Our Refund Policy sets out the full terms, including the window for reporting a problem. Nothing in these terms limits any rights you have under the consumer protection laws that apply to you.
Intellectual property
The content of this website, including photography, garment designs, written material and the Amberwall name, belongs to us or is used with permission. You may not reproduce, distribute or use it commercially without our written consent.
Acceptable use
You agree not to use this website for any unlawful purpose, to interfere with its operation or security, or to access it by automated means in order to scrape content or stockpile inventory.
Third party links
This site may link to websites we do not control. We are not responsible for their content, products or practices.
Disclaimer and limitation of liability
This website and our products are provided on an “as is” and “as available” basis, without warranties of any kind except those that cannot be excluded by law. To the fullest extent the law allows, our total liability in connection with any order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential loss.
Indemnity
You agree to indemnify and hold Amberwall harmless from any claim arising out of your breach of these terms, or your violation of any law or the rights of a third party.
Governing law
These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts of New Jersey, unless the consumer law where you live entitles you to bring it elsewhere.
Changes
We may update these terms from time to time. The version published on this page when you place an order is the version that applies to that order.
Severability
If any part of these terms is found unenforceable, the rest remains in effect.
